These Terms & Conditions govern your use of www.blackspa.in and purchases from BLACKSPA COSMETICS. By accessing the storefront, creating an account, or placing an order, you agree to these terms and the policies referenced here. If you do not agree, please do not use the services.

Eligibility and account information

You must be legally capable of entering into a binding agreement or use the store with the involvement of a parent or lawful guardian. You are responsible for providing accurate, current, and complete information and for safeguarding your account credentials.

Product information

We aim to present product descriptions, ingredients, colours, images, quantities, and availability accurately. Screen settings, packaging updates, manufacturing variations, and photography may cause minor differences. Read labels, ingredients, directions, warnings, and suitability information before use. Product information is not medical advice.

Orders and acceptance

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may limit quantities or reject or cancel an order for legitimate reasons, including stock unavailability, obvious errors, payment issues, suspected fraud or misuse, or delivery limitations. If a paid order is cancelled by us, the applicable amount will be refunded.

Prices, taxes, and payment

Prices are displayed in Indian rupees unless stated otherwise. Applicable taxes, shipping charges, discounts, and the final order total are shown during checkout. We may correct obvious pricing or listing errors and may change prices prospectively. Payment must be completed using an available method, subject to the payment provider's terms.

Shipping, cancellations, returns, and refunds

Orders are also governed by our Shipping Policy, Cancellation Policy, and Return & Refund Policy. Those policies form part of these terms.

Promotions and discount codes

Promotions may have separate eligibility rules, validity periods, exclusions, minimum spends, or usage limits. Unless stated otherwise, offers cannot be combined, exchanged for cash, or applied retrospectively. We may withdraw or correct a promotion affected by error, fraud, or misuse, subject to applicable law.

Acceptable use

You must not misuse the storefront; interfere with its security or operation; submit false information; attempt unauthorised access; scrape or copy content unlawfully; introduce harmful code; infringe another person's rights; use the services for illegal activity; or place fraudulent or abusive orders.

Reviews and customer content

If you submit a review, image, comment, or other content, you confirm that you have the right to do so and that it is accurate, lawful, and not misleading, abusive, or infringing. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, and display that content for operating and promoting the business, subject to applicable privacy law.

Intellectual property

The storefront and its branding, text, graphics, photographs, product presentation, and other content are owned by or licensed to BLACKSPA COSMETICS and are protected by applicable intellectual-property laws. No right is granted except the limited right to use the storefront for personal, lawful shopping purposes.

Third-party services and links

The storefront may rely on or link to third-party services, including Shopify, payment providers, couriers, and social platforms. Their services may be subject to separate terms and policies. We are not responsible for third-party content or services outside our reasonable control.

Disclaimers and liability

To the extent permitted by law, the storefront and services are provided on an as-available basis. We do not exclude liability that cannot lawfully be excluded. Subject to that rule, we are not responsible for indirect or consequential loss, loss caused by misuse of a product, failure to follow instructions or warnings, or events outside our reasonable control.

Indemnity

To the extent permitted by law, you agree to be responsible for losses reasonably arising from your unlawful misuse of the services, violation of these terms, or infringement of another person's rights.

Changes and severability

We may update these terms prospectively by posting a revised version with a new date. If any provision is held unenforceable, the remaining provisions continue to apply.

Governing law

These terms are governed by the laws of India. Courts with jurisdiction under applicable law may hear disputes. Nothing in these terms restricts rights or remedies available under Indian consumer law.
